Kilpatrick Chooses To Not Pay Court Ordered Fines

Worthy alleges failure to meet probation terms

Subpoenas were issued Friday ordering former Mayor Kwame Kilpatrick and his employer, Compuware, to turn over records prosecutors believe will show he violated probation and hid his true financial worth.

Why would Compuware employ a known criminal in such a high paying position?

Orders to immediately produce documents concerning Kilpatrick's pay and assets were authorized by Wayne County Circuit Judge David Groner at the request of Wayne County Prosecutor Kym Worthy.

Kilpatrick is expected to return from his Texas home next month to attend an Oct. 28 hearing before Groner on the prosecutor's allegations that Kilpatrick has "flagrantly" and "willfully" failed to meet terms of his probation stemming from guilty pleas to felony assault and obstruction of justice charges he entered last year in the text message scandal.

A second subpoena issued to Compuware demands "all payroll records, records of disbursements, including but not limited to payroll records, commission payments and or advances, car allowances, travel allowances, loans, gifts and or any other benefits and or payments made to Kwame Kilpatrick or any third party on his behalf for January 2009 to present."

Kilpatrick's lawyer, Michael Alan Schwartz, said earlier this week his client denies violating probation. Schwartz said he's not sure Worthy ever presented Kilpatrick with documents needed to transfer his bond and pension assets.

Alan PULLEEZE! Kim Worthy's office and legal administrative efforts have been nothing short of spectacularly pristine. What a pathetic excuse, is that what all those years of legal eduction get you in terms of legal expertise?...Shoot I could do that.

Schwartz labeled the coming hearing in Groner's court as "a public relations event."

Alan you just tied your wagon to Detroit's most famous criminal..probably not your best move.

Schwartz wasn't available for comment Friday. Representatives for Compuware could not be reached for comment.

Of course not, the parties most humilted by events tend to shy aware from the public eye.

Groner in March set a payment schedule based on 30 percent of Kilpatrick's monthly income.

Payments were set at $6,000 per month because the judge was told Kilpatrick would earn a base salary of $120,000, plus advances that doubled his monthly income during the first six months he worked as a salesman in Texas for Compuware subsidiary Covisint.

As part of his plea-bargain agreement, which averted a trial on multiple felony charges, Kilpatrick agreed to resign his office, serve jail time, give up his law license, not run for office during five years of probation and pay the city $1 million in restitution.

Pay stubs obtained by The Detroit News show Kilpatrick was paid $57,000 during his first six months as a salesman for Covisint. Kilpatrick also took $60,000 in advances on expected bonuses and commissions.

I know this much, I won't be buying any Covisint or Compuware products anytime soon.

This guy ruins Detroit, lives in a Texas mansion in a gated community, gets a cushy job at a "Detroit based" business, drives a Escalade and STILL tries to get out of what payments the court ordered him to provide.

How fast would you or I be in jail if we pulled this crap?

...and people say there isn't any class preferential treatment in this country....yeah right.

Kwami Kilpatrick Vs. Everyone

Former Mayor Kwame Kilpatrick is now in jail, the first of 120 days for lying to "protect your political career," a judge said as he upbraided Kilpatrick for acting with "hubris and privilege."

Wayne Circuit Court Judge David Groner chastised Kilpatrick -- who often shook his head in apparent disagreement -- during a terse monologue. Groner declared that Kilpatrick knowingly lied about his romantic relationship with his former chief of staff and cost the city millions of dollars in the process.

"At a time when this city needed transparency, accountability and responsibility, you exhibited hubris and privilege at the expense of the city," Groner said.

Minutes of Groner's pronouncement, Kilpatrick left the courtroom, handed his wedding ring to his wife, Carlita, and headed for the Wayne County Jail, where he was given a jumpsuit and had his picture taken.

During a long and often contentious hearing, Groner was declarative in his finding: Kilpatrick knowingly lied during his testimony during the whistle-blower lawsuit brought -- and won -- by two former police officers.

"These lies were to cover up your wrongful dismissal of (two) police officers," Groner said. The result cost the city the $8.5 million it paid to the officers.

The sentencing ends nine months of revelations and admissions about and from the former mayor.

All told, Kilpatrick pleaded guilty to two counts of felony obstruction of justice in a deal that calls for 120 days in jail, payment to the city of $1 million in restitution and five years on probation during which he can't run for office.

 The sentence includes Kilpatrick's punishment for his no-contest plea to the assault of two investigators who tried to serve a subpoena on a friend at his sister's home. That charge was brought by Michigan Attorney General Mike Cox.

During the at-times testy hearing, attorneys and prosecutors exchanged charges, with Kilpatrick's team claiming that calls for additional penalties amounted to "piling on" and that Kilpatrick was being treated unlike other defendants.

That charge drew an emotional response from assistant prosecutor Robert Moran, who seethed his response, claiming that Kilpatrick had "held the city hostage for six months," denying the charges until he finally pleaded guilty in September, and only after Gov. Jennifer Granholm began a historic hearing on his removal.

"We don't need public servants who lie," Moran said, and who treat the community "as their own playground."

Afterward, Wayne County Prosecutor Kym Worthy said she was satisfied with the decision.
In the end, Groner agreed to the four-month term initially set during plea negotiations. He also rejected calls for an additional $22,186 bill prosecutors sought, as well as a call for an anger management class for his confrontation with two court officers trying to serve a subpoena.
Groner said Kilpatrick "snapped" that day, but that there was no evidence of a pattern of angry behavior.

During the hearing, letters from prosecution investigators were read, portraying the former mayor as an out-of-control, intimidating bully who put their lives in danger.

Doug Baker, an attorney for Cox, read letters from Brian White and JoAnn Kinney, claiming they feared for their lives during a confrontation with Kilpatrick while they tried to serve a subpoena. Kilpatrick pleaded no contest to assaulting a court officer as part of a Sept. 4 plea deal.

Kinney wrote that the event "remains etched" in her mind forever. The former Detroit Police officer said the July 24 incident with Kilpatrick was the most dangerous of her career. Kilpatrick was accused of shouting obscenities at the officers and pushing White into Kinney as they attempted to serve a subpoena.

"I have never felt so helpless or unable to protect myself," Kinney wrote. She added that the then-mayor's bodyguards were with him during the incident at his sister's house and she worried she would get shot.

"Kilpatrick is more dangerous and frightening than any criminal I have ever encountered."
The statements were met with incredulity from Kilpatrick's supporters and his lawyers. 

Kilpatrick's attorney, Gerald Evelyn, equated them to "piling on." Leaving the courtroom, Kilpatrick's uncle, Marvel Cheeks, accused both investigators of lying.

"There is no way in the world Kwame Kilpatrick could be the most dangerous criminal they've ever encountered in their lives," Cheeks said. "I think they are saying it out of anger, revenge. They're trying to make it as bad as possible.

"They're trying to hang him. This to me is no different than the lynchings of the 1950s and 1960s. There is no justice. There should be no peace."

The hearing occasionally grew testy, as Kilpatrick's lawyers said they spent a long time agreeing to a deal, then had new penalties imposed today. At one point, Groner admonished a Kilpatrick attorney for talking too long, telling him he wanted to wrap-up the hearing.

Former city general counsel Sharon McPhail, who represented the mayor during Gov. Jennifer Granholm's ouster hearing, left the meeting and said she would have liked to have had an opportunity to address the court.

As she left the private meeting, she called the four-month jail term "overkill."

"Here's a guy with no criminal background going to jail. There are people who have killed people out on the streets," McPhail said after she left a meeting between Kilpatrick's attorneys and prosecutors. "Whatever that was done, hasn't he already paid a big price? Do we need to stomp and grind him into the ground?"

She left the hearing hours later in disgust, saying "I just don't know what's going on in there."
But she added: "I think we're all glad this chapter is over. I think dragging it out like this doesn't do anything for anybody."

After the sentencing, attorney Evelyn said that "under the circumstances, I'm convinced this is the best deal that could be achieved."

"Would I have liked a better deal for him? Absolutely. Do I feel like he deserved a better deal? Absolutely," Evelyn said. "But I wasn't the only one making the decision."
Another defense attorney, Todd Flood, was more blunt: "I don't think there were any winners today."

By about 5:30 p.m., Kilpatrick had left the courtroom and prepared to be processed at the jail. He's expected to be processed and given a used green jumpsuit with "Wayne County Jail" stenciled in the back.

Because the hearing dragged on so long, Kilpatrick will likely miss dinner. The jail was serving beef pot pie and Jell-O.

Christine Beatty's Lawyer Is Delusional


No deal: Beatty heading to trial

Prosecutor toughened offer; legal experts say mayor's ex-aide waited too long to avoid harsh punishment.

Mayor Kwame Kilpatrick's former top aide, Christine Beatty, will take her chances in court after rejecting a plea deal Monday in her criminal case stemming from the text message scandal.

"What's next? Acquittal, and don't be surprised when that happens," Beatty's lawyer, Mayer Morganroth, said after three hours of closed-door plea-bargaining Monday in the chambers of Wayne Circuit Judge David Groner.

It isn't unusual for a prosecutor's plea deal to include harsher terms after being rejected, said Larry Dubin, professor at the University of Detroit Mercy Law School. But the three-month increase in jail time seemed steep, he said, and may be an indication of Worthy's confidence in convicting Beatty at trial.

"More typically, when you make a last-ditch effort to resolve a matter, you do not increase the demands, but rather attempt to resolve the differences. So I can only assume the prosecution, as of this point, is willing to go to trial," Dubin said. "It may seem to (Beatty) and her lawyers that her only opportunity to do better than the prosecutor's offers is to go to trial."

The perjury case against Beatty also may be stronger than the case against Kilpatrick because questions put to Beatty during her testimony at a police whistle-blower lawsuit trial last year had been more direct, Dubin said.

Beatty's lawyers are likely to play for sympathy before a jury by portraying her as a victim of the mayor's ambition or his affections, he said.

"She certainly appears vulnerable," Dubin said. "All of the women involved with the mayor could be perceived as victims."

Aside from servicing him sexually, she was the mayor's right hand tool, the hammer for nails he pointed out needing hammering.

Morganroth added that he is unconcerned about the possibility of Kilpatrick testifying at that trial.

"I don't think we'd be hurt by the mayor," Morganroth said.

Beatty made no comments Monday as she pushed her way through a crowd of reporters leaving the courtroom. Her pastor, the Rev. Ronald Griffin followed, waving his hand to move the crowd. "Please. Respect! Please," Griffin said.

Morganroth declined to say what the sticking point in negotiations might be, except that the offers were "unreasonable." Although he said he had no quarrel with the four assistant prosecutors with whom he negotiated Monday, he made a reference to Worthy's personal impact on the process by adding he was frustrated "with what one person is doing."

20 Minutes Is All It Takes To Run The Country's 11th Largest City


Cockrel says meeting with Kilpatrick was productive


Mayor Kwame Kilpatrick left City Hall about 10:48 a.m. in street clothes and a baseball cap after meeting his interim successor, City Council President Kenneth V. Cockrel Jr., for about 50 minutes Monday.

Kilpatrick refused to answer questions from reporters and left on a public elevator. He usually rides in a private one.

Cockrel met with Kilpatrick about 20 minutes one-on-one. He called the meeting productive but wouldn't divulge specific topics. Cockrel also met with key staffers under Kilpatrick including deputy mayor Kandia Milton and general counsel Sharon McPhail, the point-person on the outgoing mayor's transition team.

"We just want to make sure we give him what he needs," said McPhail. "No one is angry. No one is bitter. No one is mean."

Overall, Cockrel met about 90 minutes with the mayor and staffers. Afterward, Cockrel said he wouldn't name any department heads until he becomes interim mayor next week.

Aside from handing over the keys to the Mayoral john, what the heck else can be handled in a few minutes?

I've seen introductions of business topics last longer.

They Mayor wants the appearance of really caring what happens after he leaves, no he doesn't. Kwami wants a smooth exit sohe can one day return, for whtever reason Cockrel is allowing it, probably to also look like the good guy.

I would have to say though that Cockrel appears to be a good guy, no reason to doubt his abilities or motives.

Kwami will get his chance to run for Mayor again and I bet he wins....never underestimate the stupidity of the masses.

Rats Leave The Ship When?....When It Sinks



Detroit Police Chief Ella Bully-Cummings and Sharon McPhail quickly answered the question swirling Thursday around City Hall: Who goes?

McPhail, general counsel to Mayor Kwame Kilpatrick, and Bully-Cummings announced their resignations shortly after Kilpatrick pleaded guilty to two felony charges of obstruction of justice.

Now the question for many like interim Water Director Anthony Adams remains: Who stays?

Adams is one of about 125 political appointees who serve at the pleasure of the mayor.

Amru Meah, director of the Buildings and Safety Engineering Department, said when asked for his reaction: "I'm too choked up."

Kandia Milton, Kilpatrick's chief of staff and childhood friend, declined to reveal plans.

"I'm committed to working with Mayor Kilpatrick in transitioning city government," Milton said.

Can You Hear The Train A'Coming...Kwami Gets Ready To Pack




After months of legal challenges meant to stop her, Gov. Jennifer M. Granholm of Michigan opened an unusual hearing on Wednesday to determine whether she should remove Mayor Kwame M. Kilpatrick of Detroit from office for misconduct.

Though his fate hangs on her decision, Mr. Kilpatrick did not show up to defend himself, instead, his spokesman said, going to work at City Hall as usual. But Mr. Kilpatrick’s absence suggested that he might be redoubling an effort behind the scenes to broker a plea deal with prosecutors, a resolution that could render Ms. Granholm’s proceedings moot, as any deal is likely to involve his resignation.

Resignation is Kilpatrick's one bargaining chip.

He is going to try and get as much as he possibly can out of his resigantion, preferably no jail time but lets face it that ain't gonna happen.

After this, I fully expect a clearing house of terminations from Council President, Kenneth Cockrel Jr.

Council President Kenneth Cockrel Jr. said he's prepared to take over today if Mayor Kwame Kilpatrick steps down amid a plea agreement, and said he's already put together the start of a potential staff.

He declined to be specific about who's on his short list but said he's likely to name a new chief of staff and deputy mayor. That would mean Kilpatrick's chief of staff, who is also acting as deputy mayor, Kandia Milton, would be out, among many other appointees expected to either resign or be fired.

A steady stream of people flowed in, out and around Cadillac Place on Wednesday as a hearing proceeded inside to determine whether Mayor Kwame Kilpatrick should be removed from office.

Some came to the building in the New Center area to watch history unfold. This is the first time a Michigan governor has begun the process to remove a mayor.

Calleen Jones of Detroit said she does not understand how the mayor can be kicked out of office without having been convicted of a crime.

"I don't understand how we can have hearings to oust the mayor before he is convicted of an alleged crime," she said. "I am annoyed with the news. I know there are other things going on in the state that we should be focusing on more than this."

Ok Calleen, Let me explain this mystery to you...its the city council's right and prerogative...they can ask the Governor to remove the Mayor if they feel Detroit City business cannot get due attention from his office due to circumstances...such as the text scandal. 

You can be "annoyed at the news" if you want but it is akin to being annoyed with the messenger but not the message. 

Journalists didn't make this mess, the Mayor and his upper echelon of staff did...be annoyed with them.

Aisha Bowen, a 63-year-old Detroiter, does not like the governor presiding over the ouster hearing.

"This is our house. If you aren't a registered voter in the City of Detroit, you have no business with our city," she said of non-Detroiters making decisions that impact Detroiters.

Let me edumacate you Aisha...Michigan State Law supersedes any city ruling or decision.

The mayor's aunt, Marsha Cheeks, said she will come out to support Kilpatrick every day, if necessary, as she handed out fliers claiming the "Governor continues to slap Detroit."

"When you relinquish local control to the state government, what message does that send?" she asked. "We are appalled that an elected governor would come and call a hearing and diminish our votes. She (Granholm) has clearly indicated she does not respect due process. It is a voting rights issue."

Beatty takes Fifth Amendment in records lawsuit

Christine Beatty, the former chief of staff to Detroit Mayor Kwame Kilpatrick, exercised her rights under the Fifth Amendment of the U.S. Constitution and refused to answer nearly all questions put to her at a sworn deposition Wednesday morning, a lawyer said.

Beatty took the Fifth in response to questions about whether she once carried a city-leased SkyTel pager, about text messages exchanged with the mayor and other city officials, and about a city directive that said city employees should not assume they have any privacy rights in connection with electronic messages sent with city equipment.

Kwami Tries To Negotiate Fate


Hearings loom as plea talks stumble

Judge to rule today on mayor's bid to stop governor from considering removal; legal experts predict appeal.

Prosecutors and attorneys for Mayor Kwame Kilpatrick didn't negotiate over the holiday weekend, leaving plea talks at an impasse on the eve of a crucial week in the mayor's tenure, according to a source close to the talks.

Wayne County Circuit Judge Robert Ziolkowski is set to rule at 10 a.m. today on Mayor Kwame Kilpatrick's efforts to halt hearings set for Wednesday by Gov. Jennifer Granholm on the City Council's request that she remove him from office for public misconduct.

No matter Ziolkowski's decision, legal experts predict an immediate appeal, which could buy the mayor time to cut a deal before the hearings.

Kilpatrick's lawyers claim in court papers Granholm has already made up her mind to remove the mayor.

"There's going to be appeals," said Curt A. Benson, a law professor at Thomas Cooley School of Law. "That's the way the game is being played."

Even so, Granholm plans to begin the hearings if she wins in court -- even if the mayor appeals.

"We are planning on holding a hearing unless a court tells us otherwise," said Liz Boyd, the governor's spokeswoman.

Through his attorneys, Kilpatrick has signaled to prosecutors that he is willing to quit, plead guilty to two felonies and pay the city a six-figure restitution to resolve eight felonies stemming from the text-message scandal.

But his reluctance to serve jail time -- and Wayne County Prosecutor Kym Worthy's insistence that he does -- stalled talks again last week.

What Kwami doesn't realize because his ego is so gargantuan is you don't get to negotiate or arbitrate your punishment for a crime you committed.

Detroit mayor offers to quit, pay fine, but jail time snags plea deal

Mayor Kwame Kilpatrick is offering to plead guilty to one or two felonies, leave office, pay a fine and restitution and perform community service -- so long as he doesn't go to jail, a source close to his legal team said Sunday.


Frustrated by what they consider stubbornness by Wayne County Prosecutor Kym Worthy in ongoing plea talks, the mayor's lawyers have offered to bring in facilitators -- perhaps a judge or well-respected legal figure -- to review the offer, the source said.


The talks are reaching a critical point. A Wayne County judge is set to rule Tuesday on Kilpatrick's motion to halt removal proceedings against him by Gov. Jennifer Granholm. Those proceedings are set to begin Wednesday in Detroit; lawyers claim the governor has already made up her mind to remove the mayor.

Granholm Due To Act....Maybe...Sort Of...We'll See



Gov. may decide on ouster hearing today

Gov. Jennifer Granholm is expected to announce today whether she'll proceed with hearings next week that could remove Mayor Kwame Kilpatrick from office, amid continued speculation that a plea deal could still be in the works for the embattled mayor.

Granholm is expected to announce her intentions after reading final legal arguments submitted Monday by attorneys for Kilpatrick and the City Council.

In the briefs, council attorney William Goodman argued Granholm would "set a dangerous precedent" if she fails to act or delays hearings. The mayor's general counsel, Sharon McPhail, accused the council of engaging in a disingenuous power grab.

"The Detroit City Council has wasted hundreds of thousands of dollars paying for an attorney to conduct a political witch hunt against the Mayor," McPhail wrote, a reference to Goodman, who has a contract for up to $260,000.

"(The mayor) respectfully requests that the Honorable Jennifer Granholm decline to join the lynch mob: That she stand up for the rule of law and dismiss this factually inadequate and politically motivated petition."

Kwami Says He Sorry, Won't Destroy Another City Again


Kilpatrick rejects deal for resignation

If Mayor Kwame Kilpatrick resigns office by Sept. 3, the Attorney General's office will drop one of the felony charges against him, a representative from that office said this morning at his court arraignment.

But Kilpatrick's attorney James Thomas quickly rejected the offer after the hearing, calling it "gratuitous."

Kilpatrick stood mute and the court entered a not-guilty plea on the two felony charges he faces for an alleged July 24 altercation with investigators assigned to his perjury case.

City Councilwoman Martha Reeves met with James R. Rosendall, the suspended Synagro Technologies Inc. official who is at the center of an FBI and grand jury investigation. - 07/26/2008


City Council member Sheila Cockrel said Thursday she received a grand jury subpoena to produce all her documents related to two deals approved by the City Council under federal investigation. Cockrel also confirmed that she got a letter from the FBI saying her conversations were picked up on federal wiretaps of other people's phones. Her phones were not tapped and Cockrel repeatedly has said she is not a target of the investigation and did nothing improper.

FBI agents told City Councilwoman Barbara-Rose Collins on Tuesday that she is the "subject" of a federal public corruption probe into accusations that city officials accepted money to approve a sludge-hauling contract, she confirmed. - 07/09/2008


Well one things for sure, if they received kick backs they sure didn't blow them on makeovers.

The FBI is probing the 5-4 vote last November of a contract with Synagro Technologies Inc. of Houston to provide sludge hauling. Several council members denied they are targets of the probe, which sources say has focused on a former aide to Cockrel, Synagro lobbyist James Rosendall, his minority partner in the deal, Rayford Jackson, and Councilwoman Monica Conyers.

Rosendall is a cooperating witness in the investigation. His attorneys issued a statement on his behalf Monday saying, "the Synagro contract was, and still is a good deal for the city of Detroit. It will save the city millions in sludge disposal cost. It also significantly reduces emissions in Detroit."

"I made a mistake; I did business with the city of Detroit," Rosendall said in the statement. " I am fully cooperating with the FBI."

I love that last line, it says it all doesn't it? Had to put it in bold.
